Mediation is a way that you and your ex-partner can deal with any disputes you may be having. Not only is mediation an effective way to help resolve conflict, but it is much cheaper and a lost less stressful than resolving disputes in court. If you and your ex-partner do eventually end up in court, then you will normally have to prove that you have been to mediation information and assessment meeting (MIAMs). This session is designed to help ex-partners understand how a mediator can help them, thus generally making it a requirement before court proceedings.
Mediators do not offer you any legal advice. They do however create an experience which allows you and your ex-partner to discuss things calmly, helping you arrive at solutions you may not otherwise have been able to. A mediator listens to both sides of the story and does not take sides. The aim of a mediator is to provide a solution that is best for the child, and they use their experience to help offer you solutions which work for both ex-partners and the child.
If the process is successful, your mediation will create a document setting out what you have agreed, known as a memorandum of understanding. We can help make this into a consent order, making it legally binding. Contact us to find out more about mediation.
Collaborative law is more expensive that mediation, but still less expensive than court. Although similar to court in that both sides have their own solicitors, there is no judge involved, and the four parties will work together to come up with a practical solution. In cases where collaborative law is successful, your solicitor will draw up a content order for you. If collaborative law is not the solution to your problem and you do have to go to court, you will have to move solicitor.
